France's Stablecoin Tax Proposal: The Rule That Cannot Reach the Chain

CryptoNeo • • Policy
On October 5, three French crypto executives put their names to a proposal that would tax every crypto-to-stablecoin swap in the country. The document is short on mechanism and long on intent. It was drafted not by the tax authority, not by the treasury, but by the chief executives of Deblock, Lyzi, and Waltio — a crypto neobank, a payment app, and a tax-software vendor. The first question a trader should ask is never "what does this do to price." It is "who gets paid when this rule executes." The ledger remembers what the market forgets. Baseline first. France's current regime under Article 150 VH bis CGI taxes crypto capital gains only when you convert to fiat or buy goods and services — a flat PFU of roughly 30%, inclusive of income tax and social contributions. Swap Bitcoin for a stablecoin, and the French tax code looks away. That gap is the entire premise of the proposal. The three signatories are not neutral observers of that gap. Deblock sells regulated fiat on-ramps. Lyzi sells merchant crypto payments. Waltio sells tax-reporting software. Each business model scales with regulatory friction. When the friction is zero — when a self-custodied wallet can swap BTC to USDT with no event, no form, no liability — none of them have anything to sell. Zoom out and the frame is bigger than France. The EU is already building the machinery this proposal gestures at: MiCA governs the asset side, DAC8 mandates crypto-asset reporting across member states, and the OECD's CARF extends that reporting globally. France's crypto-to-stablecoin gap is not a French curiosity. It is the exact hole the European reporting framework is designed to plug. That is the context the headline skips, and it is why this proposal should be read as an early move in a longer legislative game, not as a standalone news event. Here is where the proposal collides with physics. A blockchain swap is borderless, permissionless, and identity-blind. I spent three months in 2017 line-by-line auditing the ERC20 reference implementation before it shipped, and one lesson stuck: you can only enforce a rule at a point you control. The French state does not control a Uniswap pool. It does not control a self-custodied wallet. It cannot reach into a swap and extract a euro. So the tax has to anchor where the state does control — the fiat on/off ramp. ADAN's Claire Balva made this explicit: the tax must be paid in euros, and euros exist only at the boundary between the banking system and the chain. The proposal pretends to tax "crypto-to-stablecoin exchanges," but it can only ever tax the moment those assets touch a regulated euro gateway. That is an execution-layer mismatch, and it is fatal to the stated scope. Every taxable event would be forced through a licensed PSAN provider, a custodial wallet, or a fiat ramp. On-chain DeFi, self-custody, and cross-border swaps stay outside the net — not because the regulator chooses to exempt them, but because the mechanism cannot reach them. The practical consequence is a structural re-routing of flow. If enacted, the biggest winner is not the treasury — it is the compliant on-ramp infrastructure. All taxable activity funnels into regulated chokepoints where Deblock and its peers sit. The tax is the toll; they own the bridge. I have run this trade before. In 2022, after Terra/Luna, I pivoted from centralized derivatives to on-chain perpetuals, exploiting the spread between CeFi and DeFi price feeds. The lesson from that bear market was simple: liquidity concentrates wherever friction is lowest. A tax is friction. Push it high enough at the regulated boundary and the liquidity walks to the boundary that has none. Now the part the bull-market feed will misread. Balva's warning is the most important line in the story, and it cuts against the proposers' own case. She noted that taxing crypto-to-stablecoin swaps risks pushing users toward USDT and other unregulated stablecoins. Read that as a market-structure signal, not a moral one. The proposal's logic contains its own defeat: tightening the taxable perimeter does not expand the tax base — it migrates it. Users who today hold compliant, reportable positions would, under a new levy, have a direct incentive to move to offshore, non-reportable rails. This is the classic unilateral-taxation paradox. A single jurisdiction raising rates on a mobile asset class does not collect more; it watches the base leave. And here is the counter-intuitive trade: USDT's "unregulated" status, which regulators treat as a liability, becomes a feature under tax friction. The stablecoin the DGFiP cannot audit is precisely the one friction pushes users toward. Regulation does not eliminate demand for unregulated settlement; it concentrates it. There is a second-order effect worth watching. If "taxes paid in euros" becomes a mandatory flow, compliant euro-stablecoins like EURC could pick up incremental settlement demand — a thin but real tailwind for onshore stablecoin infrastructure. Meanwhile the offshore leg, USDT, absorbs the escape volume. The stablecoin market does not shrink under taxation; it bifurcates. I would flag one more thing almost no coverage will. Waltio, a company whose revenue is a direct function of tax-code complexity, is proposing to expand the tax code. This is a vendor recommending its own market. The "simplify payments, boost merchant adoption" framing is doing load-bearing work for what is, structurally, a request to grow the compliance surface. Audit trails are the only true alpha in chaos — and this audit trail points at the proposers' balance sheets, not the public interest. Strip the narrative and the ledger reads clean. This is a proposal, not legislation. ADAN stated plainly that the current regime is not expected to change — no near-term execution risk, almost nothing for a price model to price. On a sub-5% pricing basis, the impact on BTC and ETH is noise. But do not file it under noise. File it under precedent. France's gap on crypto-to-stablecoin swaps is the exact gap DAC8 and CARF are built to close. The likelier path to taxation is not a French statute but a European reporting mandate that turns every swap into a data point. When that lands, this October proposal gets retroactively rebranded as foresight. Watch two signals. First, whether any independent impact assessment ever accompanies the proposal, or whether it stays a vendor-authored wish list. Second, the French stablecoin mix — if compliant euro-stablecoin balances start drifting toward offshore USDT before any law passes, the tax is already working, in the wrong direction. We do not predict the wave; we engineer the board. The board says: the state can tax the ramp, not the chain. The companies that own the ramp wrote the rule. Liquidity dries up; logic remains solvent.
